Rwanda’s Initiative to Regulate Multilevel Marketing for Consumer Protection

Rwanda is implementing regulations for multilevel marketing (MLM) to protect consumers from pyramid schemes posing as legitimate operations. This initiative aims to clarify legal frameworks, enhance transparency, and secure consumer rights while ensuring MLM businesses focus on legitimate product sales instead of recruitment.

Rwanda’s government is actively pursuing regulations for multilevel marketing (MLM) to safeguard consumers from deceptive practices, particularly pyramid schemes masquerading as MLMs. The Minister of Trade and Industry, Prudence Sebahizi, stated that this regulatory action is included in the proposed draft law on competition and consumer protection currently under parliamentary review.

Multilevel marketing involves selling goods or services for a company, where participants earn commissions not only from their own sales but also from sales made by recruited participants. This differs fundamentally from pyramid schemes, which primarily depend on recruitment fees rather than product sales, leading to inevitable collapse once recruitment slows down.

Sebahizi highlighted the current unregulated state of MLM in Rwanda, which has allowed pyramid schemes to proliferate. These illegal operations often mislead consumers by utilizing money circulation schemes disguised as product sales, exploiting regulatory loopholes. Many businesses are reported to prioritize recruitment over legitimate product sales, prompting numerous complaints from consumers who have lost their investments.

An example provided by Devota Muhayimana illustrates the personal impact of pyramid schemes. After her father invested in a pyramid scheme and initially received returns, she was convinced of its legitimacy. However, her investment collapsed, and she lost her entire contribution with no recourse to recover her funds.

To combat these issues, the proposed MLM regulations aim to create legal clarity, requiring registration of MLM entities to facilitate monitoring and increase transparency. Companies would be mandated to disclose details about their earnings and pricing, ultimately protecting consumers from fraudulent schemes and ensuring revenue largely comes from actual product sales.

Enhancements to consumer rights will involve prohibiting recruitment-focused schemes, improving regulatory enforcement, and introducing a caution deposit system to safeguard consumers in the event of company failures. Stricter licensing, regular audits, and a clear delineation of revenue sources will help separate legitimate MLM businesses from fraudulent ones. Through these measures, Rwanda seeks to foster a fair and ethical MLM environment that benefits consumers and legitimate businesses alike.
