Following the reopening of an investigation into these claims last October, Khan highlighted the intensifying conflict with the M23 rebels and the Congolese military. The violent clashes have reportedly led to approximately 7,000 fatalities since the M23’s offensive began in January.
Khan stated that “Rome statute crimes have been and are being committed in the east of the DRC.” He pointed out that more than 100 armed groups are present in the region, indicating that the allegations of wrongdoing extend beyond just the M23 to include groups such as the Allied Democratic Forces (ADF). He emphasized the need for accountability among various warlords terrorizing civilians throughout the DRC.
The ICC prosecutor also mentioned the alleged involvement of Rwandan President Paul Kagame in supporting the M23 militants. Despite such accusations, Khan was cautious in discussing communication with world leaders about potential actions against those implicated in the crimes, asserting the ICC’s jurisdiction over any offenses occurring within DRC’s territory.
Khan stressed the importance of upholding legal standards in conflict situations, stating, “the law has rules, and even in conflict, people should not disregard the law.” Discussing the global context of justice, he warned against a descent into a lawless “Wild West” scenario in countries like the DRC and called for renewed commitment to upholding legal accountability.
Khan also faces significant challenges, including being under U.S. sanctions and a wanted list by Russia following arrest warrants issued for world leaders accused of war crimes. Despite these obstacles, he affirmed that the ICC is dedicated to executing its mission amid the difficulties they face today.
