Rabat – Amina Bouayach, President of the Moroccan Human Rights Council (CNDH), addressed the need for judicial reforms in Morocco during an international conference in Fez on February 14 and 15. The event, organized by the Fes Bar Association, convened legal professionals, experts, and activists to delve into pressing judicial system issues.
In her address, Bouayach emphasized the necessity of translating human rights into actionable policies. She highlighted that both the right to defense and the assurance of a fair trial must be actively practiced in courts and interrogation settings, and not merely documented in legal texts.
Bouayach outlined critical challenges observed during court monitoring and reported to the CNDH, such as guaranteeing the right to defense for all individuals, ensuring access to legal representation, and upholding the principle of adversarial proceedings in legal processes.
Moreover, she stressed the urgency of resolving cases promptly, particularly for vulnerable populations, and integrating international human rights standards into local judicial practices. Additionally, she flagged procedural inefficiencies that lead to delays, especially in the notification process, and inconsistencies in legal interpretation.
She called attention to enhancing access to justice for marginalized communities, improving legal information dissemination, and addressing regional disparities in legal practices. Finally, Bouayach mentioned that the CNDH is actively engaged in discussions on legislative reforms related to civil and criminal procedure codes and will continue to offer recommendations aimed at safeguarding rights and justice. “The respect for human rights, distinguished guests, is also measured by the effectiveness of judicial procedures in ensuring justice for victims. It is not limited to preventing violations and punishing them, but about strengthening a culture of human rights,” she concluded.
